What the council says

City of Newcastle says that if a property is a heritage item or is located in a heritage conservation area, most building works require development consent. It offers a form to request written confirmation that development consent is not required for minor or maintenance works to a heritage item, or to a building, work, tree or place within a conservation area.

Replacement or renovation of a non-original bathroom or kitchen is listed as an example of what the confirmation can cover, and the council says it will generally agree only if the work is of a minor nature and would otherwise be exempt development, if not for the site being a heritage item or in a conservation area.

What the state says, and where the two differ

The state's Codes SEPP exempts a bathroom renovation inside the existing layout unless it is constructed or installed on or in a heritage item. City of Newcastle's page speaks of a heritage item or a conservation area. This site does not reconcile the two: it reports both and says to get the council's written confirmation.

What to ask the provider

Ask whether the address is in a conservation area, who lodges the confirmation request and whether its two-week wait is in the quote's timeline. A renovation that cannot start until the council confirms is a renovation whose start date depends on the council, not on the provider.
