Bathroom Renovations in Cooks Hill

Cooks Hill is a heritage conservation area. City of Newcastle describes it as having a distinctive village character that is evocative of another time, with a key period of significance of circa 1850 to 1940. If your address is inside it, the council's written confirmation comes before any bathroom work.

Bathroom Renovations around Cooks Hill

City of Newcastle says that if a property is a heritage item or in a heritage conservation area, most building works require development consent, and that it will generally agree a minor-works exemption only if the work would otherwise be exempt development. Replacement or renovation of a non-original bathroom or kitchen is the council's own example of minor works. The confirmation must be received before any works start, and applications typically take 2 weeks.

The Codes SEPP, by contrast, excludes only a heritage item from its bathroom exemption. The two statements are not reconciled here: read both, check whether your address is in the conservation area on the NSW Planning Portal's Spatial Viewer, and ask the council.

Permits and City of Newcastle rules

Whether a bathroom renovation here needs consent is for the council to confirm in writing: the Codes SEPP exempts a bathroom renovation inside the existing layout unless it is on or in a heritage item, while City of Newcastle says most building works in a heritage item or a heritage conservation area need development consent. If the council declines to confirm that consent is not needed, a development application must be lodged.
